Privacy and Cookies Policy

The purpose of this document is to outline the terms on which I process personal data and use cookies in connection with the use of the website https://markendly.com (hereinafter the “Site” or “Website”).

Privacy Policy

I. Personal Data Administrator.

II. Information about processing individual personal data. 

1) Use of the Site. 

 I process personal data of all persons using the Site (including IP address or other identifiers and information collected through cookies or other similar technologies), for the following purposes: 

a) for the purpose of providing electronic services in terms of providing users with access to content collected on the Site; 

b) for analytical and statistical purposes, consisting in conducting analyses of users’ activities, as well as their preferences in order to improve the functionalities used and services provided; 

c) for the purpose of possible establishment, investigation or defense of claims;

d) for marketing purposes (ours and those of our partners), in particular related to the presentation of behavioral advertising. 

2) Contact. 

2.1) When you contact me via e-mail or contact form, you naturally provide me with your data such as name and e-mail address. In addition, you may also include other personal data in the body of your message. Providing the data is voluntary, but necessary to contact us.

2.2) The data provided in connection with the establishment of contact are processed for purposes: 

a) fulfillment of your request; 

b) analytical and statistica; 

c) possible establishment, investigation or defense of claims. 

2.3) The content of correspondence may be subject to archiving and we cannot determine when it will be deleted. You have the right to request the history of your correspondence with me (if it was subject to archiving), and to request its deletion, unless its archiving is justified by our overriding interest (e.g., defense against potential claims). 

3) Newsletter. 

3.1) To subscribe to the newsletter, you must provide us with your e-mail address and first name. Providing data is voluntary, but necessary to subscribe to the newsletter. 

3.2) Personal data collected for the newsletter are processed: 

a) for the purpose of providing the newsletter mailing service; 

b) in the case of targeting you with marketing content within the newsletter; 

c) for analytical and statistical purpose; 

d) for the purpose of possible establishment, investigation or defense of claims. 

3.3) Data will be processed during the operation of the newsletter, unless you opt out beforehand, which will remove your data from the email database. 

3.4) You can correct your data stored in the email database at any time, as well as request their deletion by unsubscribing from the newsletter. 

4) Marketing. 

4.1) I process your personal data to carry out marketing activities, which may consist of: 

a) displaying marketing content that is not tailored to your preferences (contextual advertising); 

b) displaying marketing content that matches your interests (behavioral advertising); 

c) targeting of e-mail notifications containing commercial information (newsletter service); 

d) the routing of e-mail notifications of offers or promotions of our own services or on behalf of third parties, which in some cases contain commercial information, in connection with an interrupted shopping process (abandoned shopping cart);

e) conducting other activities related to direct marketing of goods and services (sending commercial information by electronic means and telemarketing activities). 

4.2) In order to carry out marketing activities, in some cases we use profiling (if you consent to it). This means that through automated data processing, we evaluate selected factors about individuals in order to analyze their behavior or create a forecast for the future. 

4.3) The legal basis for processing personal data for marketing purposes is always your consent, which you may withdraw at any time. 

4.4) I process your personal data for marketing purposes in connection with targeting you with contextual advertising, i.e. advertising that is not tailored to your preferences. 

4.5) I and my trusted partners process your personal data, including personal data collected through cookies and other similar technologies, for marketing purposes in connection with targeting you with behavioral advertising, i.e. advertising that is tailored to your preferences. Processing of personal data then includes profiling. The use of personal data collected through this technology for marketing purposes, in particular for the promotion of services and goods of third parties, requires your consent, which you may withdraw at any time. 

4.6) Your Personal Data may also be used by us so that we can direct marketing content to you through various channels, i.e. via email, via MMS / SMS or by telephone. We only undertake such activities if you have given your consent, which you can withdraw at any time. 

5) Social networks. 

I process your personal data when you visit our profiles maintained on social media. This data is processed solely in connection with the operation of the profile, including to keep you informed about my activities and to promote various events, services and products. 

III. General provisions on the processing period of personal data. 

1) The period for which I process your data depends on the type of service provided and the purpose of the processing. As a general rule, your data is processed for the duration of the service or order processing, until you withdraw your consent or make an effective objection to the data processing (in cases where the legal basis for the data processing is our legitimate interest). 

2) The period of data processing may be extended if the processing is necessary for the establishment, investigation or defense of possible claims, and thereafter only if and to the extent required by law. 

3)   After the expiration of the processing period, your data are irreversibly deleted or anonymized.

III. Eligibility. 

  1. The Service User has the right to: access to the content of their personal data, rectification, deletion, restriction of processing, portability, object to processing, withdrawal of consent at any time (which does not affect the lawfulness of processing carried out on the basis of consent before its withdrawal).
  2. Notification of the User’s claim of entitlement under the said rights should be sent to [email protected].
  3. The administrator shall comply or refuse to comply with the request immediately – within a maximum of one month of receipt.
  4. You have the right to file a complaint with the President of the Office for Personal Data Protection if you consider that the processing violates your rights and freedoms (RODO).

IV. Security. 

1) I take all security and data protection measures that are required by data protection laws. I collect the data with due care and adequately protect it from access by unauthorized persons. 

2) I take all necessary measures to ensure that our subcontractors and other cooperating entities provide guarantees to apply appropriate security measures whenever they process your personal data on our behalf. 

V. Recipients of data. 

1) As I want to perform the best possible services for you, I will disclose your personal data to our trusted partners, subcontractors, and entities that cooperate with us, including, in particular, suppliers responsible for operating information systems, entities such as banks and payment operators, accounting service providers, marketing agencies (for marketing services), and our affiliates. 

2) Your personal data will be shared with other entities for their own purposes, including marketing purposes only if you consent. 

3) All entities to which we entrust your personal data and its processing guarantee the application of appropriate measures for the protection and security of such data as required by law. 

4) Due to the use of Google, Meta and YouTube, your data may be transferred to the United States (US). The legal basis for ensuring processing by these entities in accordance with the RODO is contractual clauses providing an adequate level of protection, in accordance with the standard contractual clauses set forth in Commission Implementing Decision (EU) 2021/914 of June 4, 2021 on standard contractual clauses for the transfer of personal data to third countries under Regulation (EU) 2016/679 of the European Parliament and of the Council. 

5) The level of protection of personal data outside the European Economic Area (EEA) may differ from that provided by European law. For this reason, we will transfer your personal data outside the EEA only when necessary and with an adequate level of protection. You will be notified each time. 

6) Our subcontractors, i.e. entities that provide us with services in processing your data, providing you with services or fulfilling your orders, may process your data. 

7) Depending on the purpose of the processing, we entrust your personal data to: 

a) Google LLC – for the use of Google Analytics, Google Ads, Google Signals;

b) Meta, Inc. – for the use of remarketing tools, including the ability to target ads to individuals from uploaded email databases; 

c) Webflow, Inc. – for the purpose of building and hosting the Site. 

VI. Tracking Technologies (including but not limited to cookies). 

1) My website, like almost all websites, uses cookies. 

2) Cookies are small text information that are stored on your terminal device (e.g. computer, smartphone) and can be read by our ICT system (our own cookies) or the ICT system of third parties (third-party cookies). 

3) I use essential, analytical and marketing cookies. 

4) Some of the cookies we use are deleted when your browser session ends, i.e. when you close it (session cookies). Other cookies are stored on your terminal device and allow us to recognize your browser the next time you visit the site (persistent cookies). 

5) The legal basis for processing in this regard is our legitimate interest in offering goods and services that take into account your preferences – Article 6(1)(f) RODO. 

6) Some of the features offered are only available if you use tracking technologies. 

7) If your browser allows it, you can always reject tracking technologies, but this may affect your use of the Site. You can set your cookie preferences using your browser’s help section, browser extensions, blocking instructions in installed applications, or by removing or deactivating tracking technologies such as cookies. 

8) You may encounter tracking technologies and cookies from our third-party service providers that we allow on our site and that support various aspects of our operations and services, e.g. Google Analytics, Hotjar. 

VI.I Cookie Consent. 

a. When you visit the site for the first time, you are shown information about the use of cookies. You can always change your cookie settings from your browser or delete these cookies altogether when you leave the site. 

b. However, disabling or restricting cookies may cause difficulties in using our website, as well as many other websites that use cookies. 

VII.II Custom cookies.

We use proprietary cookies to ensure the proper operation of the site. 

VII.III Third-party cookies. 

Our website, like most websites, uses features provided by third parties. This involves the use of cookies that come from these entities. These are listed below: 

(a) Google Analytics. 

Google Analytics is provided by Google LLC, 1600 Ampitheatre Parkway, Mountain View, CA 94043, USA. We rely on our legitimate interest in using Google’s services, which is to create and analyze statistics to optimize our website. 

As part of Google Analytics, we use a User-ID feature that allows us to associate a persistent identifier of an individual user with engagement data from one or more sessions initiated on one or more devices. 

You can disable the collection of cookies in your browser settings or clear them as soon as you leave the Website.

b) Google Ads. 

Google Ads is provided by Google LLC, 1600 Ampitheatre Parkway, Mountain View, CA 94043, USA. It allows us to attract attention to our content and offers through advertising material on external websites. We analyze data from advertising campaigns in order to optimize advertising activities. 

We do not collect or process any personal data on the basis of the aforementioned advertising means. We do not obtain other data, we cannot identify users based on the information obtained. You can disable the collection of cookies in your browser settings or clear them as soon as you leave the Website.

c) Google Signals.

Google Signals is provided by Google LLC, 1600 Ampitheatre Parkway, Mountain View, CA 94043, USA. We use Google Signals, which is an extension of Google Analytics services, for web analytics purposes. Google Signals enables what is called “cross-device tracking” (identifying users using multiple devices). This means that if your Internet-enabled devices are connected to your Google account, and you have activated the “personalized advertising” options in your Google account, then Google can generate reports on how you use our site (in particular on the number of users using different devices), even if you change devices. 

We do not process your personal data in this regard, we only receive statistics based on Google Signals functions and technologies. You can disable the collection of cookies in your browser settings or clear them as soon as you leave the Website. 

e) Meta Pixel.

Meta Pixel is available as part of Facebook and is provided by Meta, Inc., 1602 S. California Ave. Palo Alto, CA 94304, USA. As part of this tool, we target you with Facebook ads. We perform these activities based on our legitimate legal interest in marketing our own products and services. 

In order to target you with advertisements personalized to your behavior on our site, we have implemented Pixel Meta within the website. It automatically collects information about your use of our site in terms of the pages you view. The information collected within Pixel Meta is anonymous – it does not allow us to identify you. We can only get a glimpse of what actions you have taken within our site. 

As a point of information, however, I draw your attention to the fact that Facebook may combine this information with other information it has collected as part of your use of Facebook and use it for its own purposes, including marketing. Such actions by Facebook are not dependent on us, and you can find more information about this directly there: https://www.facebook.com/privacy/explanation

However, you can manage your privacy settings and profile content from within your Facebook account. 

f) LinkedIn Insight Tag. 

LinkedIn Insight Tag is provided by LinkedIn Ireland Unlimited Company, Wilton Pl, Dublin, Ireland. LinkedIn Insight Tag is a short JavaScript code that allows you to receive detailed campaign reports and get valuable information about your visitors. With Insight Tag, you can track conversions, retarget site visitors and view the demographics of LinkedIn members who visit the site. Collecting data with the help of LinkedIn Insight Tag is completely secure – no personal information is transferred – only information such as URLs, IP addresses, device and browser information is collected.

g) Social media tools. 

The website uses plugins and other social tools provided by sites such as: Facebook, Twitter, LinkedIn, Pinterest and TikTok. 

When displaying our website, which contains such a plug-in, your browser will establish a direct connection to the servers of the social network administrators (service providers). The content of the plug-in is transmitted by the respective service provider directly to your browser and integrated into the site. Thanks to this integration, service providers receive information that your browser has viewed our site, even if you do not have a profile with the respective

service provider, nor are you currently logged in with him. Such information, together with your IP number, is sent by your browser directly to the server of the given service provider (some servers are located in the USA) and stored there. 

If, on the other hand, you have logged into one of the social networks, this service provider will be able to directly attribute your visit to our site to your profile on the respective social network. 

If you use the plug-in in question to share the material, the corresponding information will also be sent directly to the server of the service provider in question and stored there. 

In addition, this information will be published in the respective social network and will appear to those added as your contacts. The purpose and scope of data collection and its further processing and use by service providers, as well as the possibility of contacting you and your rights in this regard and the possibility to make settings to ensure the protection of your privacy are described in the privacy policies of individual service providers.

If you do not wish social networks to attribute the data collected during your visit to our site directly to your profile on a particular service, then you must log out of that service before visiting our site. You can also use browser extensions that block scripts – then you will prevent these plug-ins from loading. 

h) Video recordings. 

We embed videos from YouTube on our site. Cookies from Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA regarding the YouTube service are used for this purpose. The cookies are only loaded when the video is played. If you do not agree to their loading, refrain from playing the video. 

When you play a video, Google receives information about it, even if you do not have a Google profile or are not logged in at the time. If you have logged in to Google, this service provider will be able to directly assign the video playback on our site to your Google profile. The purpose and scope of data collection and their further processing and use by the service provider, as well as the possibility to contact us and your rights in this regard and the possibility to make settings to ensure the protection of your privacy are described in Google’s privacy policy.

If you do not want Google to attribute the data collected during video playback directly to your profile on a particular site, then you must log out of that site before visiting our site. You can also completely prevent plug-ins from loading on the site by using the appropriate extensions for your browser, such as script blocking.

VII.IV Relevant marketing techniques. 

1) I use statistical analysis of website traffic. We do not transmit personal data to the operator of these services, only anonymized information. The service is based on the use of cookies on your end user device. 

2) I use remarketing techniques to tailor advertising messages to your behavior on the Site. A technological prerequisite for such activities is that cookies are enabled. 

3) I use a solution to study User behavior through heat mapping and recording, tracking behavior on the Site. This information is anonymized before it is sent to the service provider so that he does not know which individual it relates to. In particular, typed passwords and other personal information are not recorded. 

4) I use a solution that automates the operation of the Site with respect to Users, e.g., that can send you an email when you visit a particular subpage. 

VI.V Cookie management. 

1) If you do not want to receive cookies, you can change your browser settings. We stipulate that disabling cookies necessary for authentication processes, security, maintenance of user preferences may hinder, and in extreme cases may make it impossible to use the Site.

VII. Server Logs. 

1 The use of the site involves sending queries to the server where the site is stored. Each request made to the server is recorded in the server logs. The logs include, among other things, your IP address, the date and time of the server, information about the web browser and the operating system you are using. The logs are saved and stored on the server. 

2) The data recorded in the server logs are not associated with specific individuals using the site and are not used by us to identify you. 

3) Server logs are only auxiliary material for the administration of the site, and their contents are not disclosed to anyone except those authorized to administer the server. 

4) The legal basis for processing in this regard is our legitimate interest in ensuring the proper functioning of the site.

VIII. Changes to the Privacy Policy. 

This Policy is reviewed on an ongoing basis and updated as necessary. The current version of the Policy has been adopted and is effective as of 01.11.2023.
